NovaTabz Terms of Service

Welcome to NovaTabz. These Terms of Service ("Terms") govern your access to and use of novatabz.com (the "Site") and your purchase of products from Nova Labs Innovation Inc. ("Nova Labs," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Nova Labs Innovation Inc. is a Delaware corporation operating the NovaTabz brand of oral care products. The Site is an active e-commerce store through which we sell and ship NovaTabz products directly to customers in the United States.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. By placing an order, you represent that you meet this requirement.

3. Products and Orders

• All product descriptions, images, and pricing are subject to change without notice.
• We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion, including in cases of suspected fraud, pricing errors, or unavailability of inventory.
• Orders are only accepted once you receive an order confirmation email. An order confirmation does not guarantee product availability.

4. Pricing and Payment

• All prices are listed in USD and are subject to applicable sales tax.
• Payment is processed securely at checkout through Shopify Payments. We do not store your full payment card information.
• You represent that any payment information you provide is accurate and that you are authorized to use the payment method provided.

5. Shipping

Shipping timelines, costs, and eligible regions are described in our Shipping Policy. By placing an order, you agree to the terms of that policy.

6. Refunds

Our refund terms are described in our Refund Policy. By placing an order, you agree to the terms of that policy.

7. Subscriptions

If we offer subscription products on the Site, subscriptions will renew automatically at the interval and price disclosed to you at the time of signup, until cancelled. You may cancel your subscription at any time prior to your next scheduled billing date through your account or by contacting us at support@novatabz.com. We will provide clear disclosure of subscription pricing, billing frequency, and cancellation instructions at the point of signup, in compliance with applicable auto-renewal laws.

8. Health and Safety Disclaimer

NovaTabz products are cosmetic oral care products. They are not intended to diagnose, treat, cure, or prevent any disease. Statements regarding our products have not been evaluated by the FDA or Health Canada. If you have a dental or medical condition, are pregnant, nursing, or have known allergies or sensitivities, consult a healthcare or dental professional before use. Discontinue use and consult a professional if irritation occurs.

9. Intellectual Property

All content on the Site — including trademarks, logos, product names, images, and text — is the property of Nova Labs Innovation Inc. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

10. User Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to interfere with the security or proper functioning of the Site
• Submit false or misleading information when placing an order
• Use automated means to access or scrape the Site without our consent

11. Limitation of Liability

To the fullest extent permitted by law, Nova Labs Innovation Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim arising from your purchase shall not exceed the amount you paid for the product giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Nova Labs Innovation Inc., its officers, directors, and affiliates from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Site or products.

14. Dispute Resolution — Binding Arbitration and Class Action Waiver

Please read this section carefully — it affects your legal rights.

Any dispute arising out of or relating to these Terms, the Site, or your purchase of products shall be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

Class Action Waiver: You and Nova Labs Innovation Inc. agree that any arbitration or proceeding shall be limited to the dispute between us individually. You waive any right to participate in a class action, class arbitration, or representative action against us.

Opt-Out: You may opt out of this arbitration provision by sending written notice to support@novatabz.com within 30 days of your first order, stating your name, order number, and intent to opt out.

This section does not limit any rights you may have that cannot be waived under applicable state or federal law.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, except where superseded by applicable federal law or mandatory consumer protection laws of your state of residence.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
